Indian Tribal Courts

Congress has plenary or complete authority over Indian affairs. This means that Congress has unlimited discretion to regulate affairs on an Indian reservation. Under federal law, Indian nations are quasi-sovereign; that is, they have power in some areas but not in others. For example, Indian nations can operate tribal governments and manage their own property and resources. However, they cannot conduct foreign relations or prosecute non-Indians who commit crimes on reservations. Indian nations have adopted tribal codes, which usually combine traditional law with state law and federal law.

Impaired Driving -- Fatigue, Cell Phone Use, And Telematics

Impaired driving refers to anything that distracts a driver and interferes with his/her capable performance of the task of driving. Driving can be impaired by drug use, alcohol use, driver fatigue, cell phone use, and anything else that distracts the driver, such as eating food or putting on makeup. The use of computers and navigation devices in cars called telematics can also distract a driver. This article explores driver fatigue, cell phone use, and telematics.

Appeal of a United States District Court Judgment

The party who loses in a civil lawsuit can file an appeal after a United States District Court, a federal trial court, enters a final judgment in the case. The notice of appeal must be filed with the district court clerk within 30 days after the judgment. The person filing the appeal is called the appellant, and the other party is called the appellee.

Restrictions on Judicial Campaign Speech

Each branch of the armed forces has its own judicial system. Each service (Army, Navy, Marine Corps and Air Force) has a JAG, who is the senior legal officer of that branch of the armed forces. The JAG is charged with administering military justice and with providing legal advice, opinions, and assistance to those who serve in the military.

Probate Courts

A probate court is a specialized court that handles the probate of wills, administers the estate (property) of a deceased person, appoints guardians for minors and incapacitated adults, and orders the involuntary hospitalization of persons in need of medical treatment. In some states, the probate court also deals with such issues as terminating parental rights and approving adoptions. Some probate courts also issue marriage licenses and grant name changes. The probate court in New York, as well as in some other states, is called the surrogate's court. Ohio has a probate division in the common pleas court, which is the trial level court in Ohio.
